In the courts : Taking Moore and Doughty to the wood shed

Janet White has now filed a response to the preposterous notions of Doug Moore as propounded through his "attorney" Robert Doughty. Unless District Judge James Waylon Counts intends to declare himself incompetent and biased we should soon see Moore's silly and un-American challenge to White's candidacy tossed from the courts like a prostitute's used condom.

Of course we have to now wait as Doughty gets one more opportunity to embarrass not only himself, but Doug Moore and the Republicans of Otero County as well.If this matter is of any interest to you at all you just have to read this response (Response PDF). Compared to the response which is well researched, reasoned, cited and executed Doughty's brief (Brief PDF) comes across more like the ravings of a half insane half drunk shortwave "patriot" working out of a bunker.

Here are some quotes which, while not necessarily indicative of this journeyman job of slicing Doughty's frivolity apart, make not only the thing worth reading, but also give you an idea how far Mr. Doughty had to reach in order to put the frail and spindly legs on this that allowed it to get a case number:

"The strength of Moore's argument is best illustrated by his carte blanche reliance on a misinterpretation of New Mexico law.""Moore has used two pages and four paragraphs in his brief to directly attack the provisions contained in White's nominating petitions but when asked, denies that he is doing so in an attempt to evade the requirements of Section 1-8-35.""Moore also cites to Beagles v. Gutierrez, Chavez County Cause No. CV-2005-1169. Beagles is irrelevant and not even on point."

And finally:"The conclusion that [Moore] having to run a campaign constitutes irreparable injury is absurd."

This response is really worth the 10 minutes it takes to read it - especially in contrast to the nonsensical blather of Doughty's brief. While Doughty is forced to attempt to twist the words of the law around in circles in an attempt to avoid the actual law the response is able to simply cite the law in order to render Robert Doughty's misrepresentations frivolous and foolish.

Those of you who had any respect for either Robert Doughty or Doug Moore prior to this will have to resort to the most noxious of partisan rationalizations in order to maintain it now unless, of course, you are a psychopath.

I used comparative shopping, experience and a bit of intuition when I selected my attorney. My criteria were (1) straightforwardness and (2) clarity. Miguel Garcia, Esq. has not disappointed me in any way.
