IS IT JUST ME, OR ARE PEOPLE REALLY GETTING MEANER?

Is it just me, or are people really getting meaner? It seems that much of what I hear and read these days indicates that people's actions and attitudes are increasingly rude, crude, and downright cantankerous. Has it always been this way? If it was, I don't remember it.
Granted, there is much to be upset about nowadays. People are being taxed out of their minds. Governmental meddling has never been more intrusive. Savings accounts are down. Indebtedness is up. Most newspaper headlines serve only to raise our blood pressure. Americans fear the IRS more than they do Osama bin Laden. Many Americans are working two and even three jobs just to make ends meet.
Hollywood used to provide respite from day to day pressures. No more. All they do now is contribute to raising stress levels. Ditto for most major league sports. And when is the last time we could trust anything our congressman told us? Come to think of it, we can't trust much of anything anybody tells us.
Egad! I'm getting angry just writing this column.
However, is it really obligatory that we lose our warmth and compassion? Is everyone who disagrees with us really our enemy? Can we not remain truly uncompromising for a principle without becoming a raving, sadistic madman?
Furthermore, it doesn't seem to matter in what "camp" one finds oneself. The story is the same. Conservatives can be just as mean-spirited as liberals and vice versa. Christians just as contemptuous as atheists. In fact, I know unbelievers whom I would far rather be around than some believers.
In addition, I used to believe that ladies were the "kinder, gentler" sex. No more. Heaven help the person who crosses some of these avant-garde females. And pity the poor man that marries one of these angry American women.
Even people who try to work with youngsters feel the wrath of an out-of-control, angry society. Sunday School teachers. Public school teachers. Christian school teachers. Private school teachers. Day care workers. Baby sitters. And especially Little League coaches. Those people take their lives in their hands!
Okay. So we're not all going to sit around a campfire and sing Kumbaya. Can we not at least be civil with one another? As my dad used to say, "Can't we disagree without being disagreeable?"
For the most part, Americans have developed a very unhealthy anger attitude. We have lost our sense of humor, not to mention our ability to forgive. Even Christians have become egotistical, proud, and arrogant. No wonder we have lost the propitious smile of Heaven.
For example, when people with whom we disagree get into trouble with the federal government or the mainstream media, we rejoice in their tribulation, not realizing that the same monster could turn against us with the flip of a coin (or administration). How is it that we cannot see that the same liberties and principles that we desire for ourselves must be granted to others, or we all lose?

The only people who benefit from this anger-addicted society are the power-brokers and controllers who desire to transform America into an international Monopoly game. You see, angry people are easy to manipulate, because they have lost their ability to reason.

While walking down the street one day a US senator is tragically hit by a truck and dies. His soul arrives in heaven and is met by St. Peter at the entrance. "Welcome to heaven," says St. Peter. Also present is the devil, who really is a very friendly guy who has a good time dancing and telling jokes. They are having such a good time that before he realizes it, it is time to go. Everyone gives him a hearty farewell and waves while the elevator rises...The elevator goes up, up, up and the door reopens on heaven where St Peter is waiting for him. "Now it's time to visit heaven."

So, 24 hours pass with the senator joining a group of contented souls moving from cloud to cloud, playing the harp and singing. They have a good time and, before he realizes it, the 24 hours have gone by and St. Peter returns. "Well, then, you've spent a day in hell and another in heaven. Now choose your eternity. "The senator reflects for a minute, then he answers: "Well, I would never have said it before, I mean heaven has been delightful, but I think I would be better off in hell." So St. Peter escorts him to the elevator and he goes down, down,down to hell.

Now the doors of the elevator open and he's in the middle of a barren land covered with waste and garbage. He sees all his friends, dressed in rags, picking up the trash and
putting it in black bags as more trash falls from above.The devil comes over to him and puts his arm around his shoulder. "I don't understand," stammers the senator. "Yesterday I was here and there was a golf course and clubhouse, and we ate lobster and caviar, drank champagne, and danced and had a great time. After admitting that he had no real means of countering the position of Otero County Clerk Robyn Silva (PDF) Doughty was forced to resort to defamation of Silva stating (PDF):The Clerk's Response Brief is written to politically justify what she had done.I'm thinking we are not only getting to see the real Robert Doughty and Doug Moore, but also some real reason for concern as to why they are going to these lengths to keep Moore in his office. Regardless of the outcome here it has now become imperative to keep a close eye on every official act of Doug Moore in order to assure citizens his motives are pure.If that unseemly conduct is not enough to convince you these two are desperate and unprincipled perhaps this other little nugget will. Before launching into his rambling attempt to keep his misrepresentations in play on (PDF) page 2 of his reply Doughty launched into some blather about how Doug Moore's son had just returned from Iraq after fighting the forces of terrorism in order to secure the freedom of democracy. When you read this you just might feel the presence of the men in white dragging Bob Doughty back to his rubber room. It just went downhill from there. From that point on Doughty's response was roughly the equivalent of, "Oh yeah!" and "Says you!". The apples and oranges of Doughty's arguments were so poorly cobbled together it was hard to believe the guy was a lawyer much less a former judge. The one thread that ran clearly through this was Bob Doughty's consistent avoidance of the actual law of this case citing nonsensical case law that Carrillo pointed out were entirely unrelated.It is kind of easy to tell when Bob Doughty is lying to the court or is just without any authorities to back up his arguments. You will see, "...as a matter of law..." or "by law" standing alone as Doughty's assertion of authority. What makes Doughty a sub-par attorney is that when given the chance to cite several cases he seems to typically find one that, if the other side will read it, usually contains something to undermine either his current argument or one of his other Ridiculosities. All I will note on this is read Sims v. Sims.It is a shame that men like Robert Doughty and Doug Moore have any standing in the community. I know my ancestors did not give their lives to allow a cowardly politician represented by a dishonest lawyer sue his way into office by twisting and perverting the law into some perverse set of laws tailored to subvert the very foundation of this nation. If this is the best lawyer in this town, God help you when a real one comes to town and rips this one a new rectum.The very idea that Moore has any equity interest in a public office seems a bit offensive to me. Public office is supposed to be a public trust, not some platform from which to enrich one's self, nor should it be considered such that having to convince voters to elect you considered a legal harm. There was a time when public service was the motive behind running for a local office. By their actions and their very arguments in this case Robert Doughty and Doug Moore have asked a court to change that definition to reflect a pecuniary interest to be won like a lottery or raffle. One cannot help but wonder what there is about the office of County Commissioner that is worth this fight. What could possibly be so important and valuable? That is the question that demands an answer.

In the courts : Taking Moore and Doughty to the wood shed

Janet White has now filed a response to the preposterous notions of Doug Moore as propounded through his "attorney" Robert Doughty. Unless District Judge James Waylon Counts intends to declare himself incompetent and biased we should soon see Moore's silly and un-American challenge to White's candidacy tossed from the courts like a prostitute's used condom.

Of course we have to now wait as Doughty gets one more opportunity to embarrass not only himself, but Doug Moore and the Republicans of Otero County as well.If this matter is of any interest to you at all you just have to read this response (Response PDF). Compared to the response which is well researched, reasoned, cited and executed Doughty's brief (Brief PDF) comes across more like the ravings of a half insane half drunk shortwave "patriot" working out of a bunker.

Here are some quotes which, while not necessarily indicative of this journeyman job of slicing Doughty's frivolity apart, make not only the thing worth reading, but also give you an idea how far Mr. Doughty had to reach in order to put the frail and spindly legs on this that allowed it to get a case number:

"The strength of Moore's argument is best illustrated by his carte blanche reliance on a misinterpretation of New Mexico law.""Moore has used two pages and four paragraphs in his brief to directly attack the provisions contained in White's nominating petitions but when asked, denies that he is doing so in an attempt to evade the requirements of Section 1-8-35.""Moore also cites to Beagles v. Gutierrez, Chavez County Cause No. CV-2005-1169. Beagles is irrelevant and not even on point."

And finally:"The conclusion that [Moore] having to run a campaign constitutes irreparable injury is absurd."

This response is really worth the 10 minutes it takes to read it - especially in contrast to the nonsensical blather of Doughty's brief. While Doughty is forced to attempt to twist the words of the law around in circles in an attempt to avoid the actual law the response is able to simply cite the law in order to render Robert Doughty's misrepresentations frivolous and foolish.

Those of you who had any respect for either Robert Doughty or Doug Moore prior to this will have to resort to the most noxious of partisan rationalizations in order to maintain it now unless, of course, you are a psychopath.

GUBERNATORIAL CANDIDATE MARY STARRETT FRIGHTENS G.O.P. GOLIATH

Conservative firebrand Mary Starrett will be listed on the ballot as a gubernatorial candidate for the Oregon Constitution Party in November, according to Secretary of State Bill Bradbury.
Starrett's candidacy was questioned by former GOP lawmaker and practicing attorney Kelly Clark, when he filed a complaint alleging that the Constitution Party had failed to fulfill the public-notice requirements contained in Oregon's election law. Clark accused the Constitution Party of irregularities in the nomination process and demanded that Starrett's name be taken off the election ballots for the upcoming Governor's race.


"With documentation in hand, Bob [Ekstrom] went to the office of the Secretary of State to prove that there was nothing inappropriate about the process in which I was nominated for governor," Starrett told NewswithViews.com during an interview on Monday.

"We want the voters to know that we've done everything necessary to run an honest and open campaign," she added.

Documents Ekstom brought to the Secretary of State and election officials included hardcopy proof that the Constitution Party complied with the election law requirement regarding public-notices.

However, even Democrat Governor Ted Kulonoski's campaign manager, Jim Ross, believes it was the state GOP that's behind the attempt to put the kibosh on Starrett's campaign.
''I think the fact that this is being pushed by such a prominent Republican shows that those around the Republican nominee for governor, Ron Saxton, are very concerned about Mary Starrett," Ross said.

''The courage of her convictions on the issues that matter most to Republicans are very likely to give Ron Saxton problems if she is on the ballot. And I am certain they would like to avoid that if at all possible,'' he told the Oregonian.

"While Saxton claims he's a conservative, his voting record and his past statements indicate he's what conservatives call a 'RINO' (Republican In Name Only), having more in common with liberal Republicans in the Northeast than with stalwart conservatives" said NewswithViews.com publisher/editor Paul Walter.

"It's a shame how the Republican Party [in Oregon] sues to eliminate their competition with frivilous lawsuits. If they ran a real honest conservative they wouldn't have the problems they now face," Walter added.

Mary Starrett, a former radio talk show host and news anchor, is popular among conservatives and many moderates in Oregon. In an election cycle filled with spin nationwide, Starrett gives the voters "straight talk" and consistency.

Bob Ekstrom, Chairman of the Oregon Constitution Party, said in an exclusive interview with NewswithViews.com, "This [was] a cheap shot attempt to remove our candidate from the ballot. Two years ago, our political opponents tried the same tactic. An attempt to silence Mary Starrett is a telling sign that Ron Saxton knows he cannot win a fair election."

Springer traveled from Seattle for the interview since Starrett is garnering national media attention.

Here they come folks. Doug Moore's attorney Robert Doughty, hoping that politics will win his case, is once again twisting the words of the law to make New Mexico look more like Old Mexico. From beginning to end Doughty argues that politics and political parties are synonymous with elective franchise which they are not. Doughty has filed the written argument Judge Counts ordered last week (Read it - 750k). Interestingly enough Doughty responded to arguments not made by any of the parties in the lawsuit, but that were raised here. I want to thank him for taking that bait. Follow along as I once again try to untangle the rather un-American positions of Moore and Doughty.

GOP GUBERNATORIAL CANDIDATE WANTS TO ELIMINATE COMPETITION

"This is turning out to be the most astonishing Oregon gubernatorial race we've ever seen," said KATU-TV's political analyst Tim Hibbetts. And it appears Hibbetts is right.
Adding to the drama of a heated gubernatorial race, a former Republican lawmaker in Oregon filed a state elections complaint on Friday night seeking to knock off third-party gubernatorial candidate, Mary Starrett, from the November 2006 ballot. Kelly Clark, a practicing attorney, filed his complaint claiming that her nomination process was legally flawed.
Starrett, a former TV talk show host, news anchor, and anti-abortion activist, will appear on the fall ballot as the Constitution Party's nominee for governor. The popular conservative is expected to score big with Oregon's conservatives and independent voters.
Many within the state's GOP are frightened that Starrett will siphon off votes from the liberal Republican candidate, Ron Saxton, thus helping incumbent Democrat Gov. Ted Kulongoski to remain in office. What seems to frighten them even more is a Starrett win, which will turn the spotlight on the GOP's attempts to fool voters into believing they are the party of the conservative movement.
Clark claims the Constitution Party violated state election law by failing to file a notice in a newspaper announcing the party's June 3 nominating convention in which Starrett was selected by delegates to be their gubernatorial nominee.
''We searched every major newspaper, and we could not find any indication that they publicized a notice of their convention,'' Clark said in an interview with AP Friday night.
''If we are right, and the party didn't follow proper process, then Mary Starrett doesn't belong on the ballot'' he said.
Bob Ekstrom, Chairman of the Oregon Constitution Party, said in an interview with NewsWithViews.com, "This is a cheap shot attempt to remove our candidate from the ballot. Two years ago, our political opponents tried the same tactic. An attempt to silence Mary Starrett is a telling sign that Ron Saxton knows he cannot win a fair election."
Ekstrom tells NewsWithViews.com, "The Secretary of State has validated our nominating process in the past, and we are confident they will do the same now."
The politically savvy Ekstrom characterizes the Saxton campaign as reenacting the Tanya Harding saga – with Starrett as Olympic skater Nancy Kerrrigan – while Kelly Clark plays the goon!
If Mary Starrett is at all worried about being booted off the ballot this November, she isn't showing it. If anything, she says, she's flattered that the GOP fears her candidacy.
''It is kind of sad - it is kind of desperate,'' she said. ''You have a losing campaign, a losing candidate who has tried to pass himself off as conservative, and people ain't buying it. Apparently, we have the Saxton campaign running scared, which is eminently flattering. Kelly Clark would have no reason to do this, other than that he is carrying water for the Saxton campaign.''
But Felix Schein, a spokesperson for Saxton, told AP that the campaign had nothing to do with Clark's complaint. ''Neither our campaign, nor Ron has ever had a discussion about this with Kelly Clark,'' Schein said. ''In fact, we dismissed the possibility of pursuing such a complaint."
Jack Brown, the vice chairman of the Oregon Constitution Party, maintains that his party had sent postcards to all the members in the counties where they were organized, and had newspapers with the widest circulations in all of those counties publish notices.
Brown said the complaint was politically motivated, an opinion shared by Jim Ross, Gov. Kulongoski's campaign manager.
''I think the fact that this is being pushed by such a prominent Republican shows that those around the Republican nominee for governor, Ron Saxton, are very concerned about Mary Starrett," Ross said.
''The courage of her convictions on the issues that matter most to Republicans are very likely to give Ron Saxton problems if she is on the ballot. And I am certain they would like to avoid that if at all possible,'' he told OregonLive.com.

The complaint urges the secretary of state's office to remove Starrett's name from the ballot by Wednesday, August 23. If that request is denied, then Clark says a lawsuit will be filed in Marion County Circuit Court to remove Starrett's name from the ballot.
One of the NewsWithViews.com editors, Paul Walter, who lives in Oregon and closely follows Oregon politics, says he believes the fix is in. "If the secretary of state refuses to comply with Clark's request and the case goes to court, some black-robed lawyer just may rule in Clark's and Saxton's favor."

Clark claims the complaint was not filed in coordination with the Saxton campaign or Oregon Republican Party. But he conceded that he filed the complaint on behalf of some of Saxton's supporters.
Ekstrom said that the Oregon GOP is trying to punish Starrett for their own mistake. "The Republicans chose the wrong candidate for governor -- and they know it! They picked a pro-abortion, big-government-loving, counterfeit conservative (RINO). Oregonians are beginning to figure it out."

It lasted almost three and one-half mind and bottom numbing hours. The upshot is that the attorneys were put on a schedule to submit their briefs and Judge Counts told us that a decision will be made by September 14, the deadline for Robyn Silva, County Clerk, to submit names for the ballots. There is no doubt in my mind that had there not been an ending date imposed by state printing requirements, that Doug Moore's attorney would have liked to drag this out ad nauseum .

To my loyal and patient supporters and the curious: Thank you for being civic-minded and caring about Otero County.

I would venture to guess that it never occurred to my opponent or his advisors that it would be defeating the whole purpose of my campaign to somehow run illegally. Isn't it just precious that when someone tells you something about someone else, they are telling you more about themselves than the other person? Listening can be so enlightening. The GTE Security Department requested that I share this information with EVERYONE I KNOW. After checking with Verizon they said it was true, so do not dial 90# for anyone !!!!!"

Last night at the County Commission meeting Doug Moore recused himself from the vote to "rehire Ray Bailey" as court security/transportation. Mr. Moore's recusal came at the request of John Turney, my brother, who is aware that Ray Bailey was hired as a private investigator by Mr. Moore through his attorney, Robert Doughty, to investigate me.

As a result of one of Mr. Bailey's activities in investigating me for Doug Moore, I have filed a complaint with the Licensing Board of the State of New Mexico. As it stands now, Mr. Bailey is in the ten-day response period to reply to the State about my complaint.

Doug Moore's recusal is ONE decision he has made since I have been keeping a watch that I agree with. Now I can say that Doug Moore and I agree on something.

And it is not just me.... Would anyone care to explain why County Commission meetings and City Commission meetings are held on the same night?

Oh, yes. TONIGHT County meeting 6:00 pm County Courthouse on New York and 10th, second floor. City meeting 6:45 pm City Hall at 9th and Washington.

July 27, 3006: Janet White's RESPONSE TO VERIFIED APPLICATION filed. White asks the court award judgment against the Petitioner Doug Moore for her costs incurred in defending this cause of action and further award judgment against the Petitioner Doug Moore for White's attorney fees and costs for this spurious cause of action and, of course, for such other relief as the Court deems proper.

August 2, 2006: Janet White's MOTION FOR JUDGMENT ON THE PLEADINGS and MEMORANDUM IN SUPPORT file with the Court.

August 2, 2006: Janet White's attorney informs her that Robert Doughty, attorney for Doug Moore, has requested that Janet White be deposed on August 8.

August 4, 2006: Janet White receives response from REGULATION & LICENSING DEPARTMENT, State of New Mexico, Re: Private Investigator and Polygraph Board, Complaint #2006-05, Respondents - Ray Bailey and Darryl Morgan. Mr. Bailey and Mr. Morgan have ten (10) days to respond from July 31, 2006. (After I have cleared it with counsel I will print the complete complaint.)

Otero County Commission held its work session today. I took notes and will report more fully in a day or so. I went to the Willie Estrada Civic Center and caught the last speaker in Congressman Pearce's Methamphetamine Townhall Meeting. Those who were there for the whole meeting filled me in and it sounds as though the Mike Haymes and Johnny Oliver radio show at 7:00 a.m. was a lot more informative over all. Alamogordo is very lucky to have early morning talk shows five days a week. Mike and Johnny on Monday, Wednesday and Friday; and Jean Vallance and Mike Shinaberry on Tuesdays and Thursdays. Friday Night in Weed - People for Otero County had their annual potluck. The food was great, the weather beautiful, and the discussion was informative. Guest speaker, Dr. Martin Moore, County Administrator, told us about his responsibilities, his philosophy, and his background. Members and officers gave their reports. If you are interested in joining an outstanding group of individuals, let me know. Here is an excerpt from their By-laws just to let you know what their priorities are:

To encourage citizens to become involved in standing up for and preserving those fundamental and God given rights, We will uphold and support the Constitution of the United States of America and the Constitution of the sovereign State of New Mexico."
